For those of you who might be wondering about m;y health, I am happy to report that I have fully recovered and am healthier and stronger then I have been in over 20 years. My health was not my reason for my absence. I just needed some time away and appreciate your understanding. I will, however, be back right after the New Year.

Barack Obama, Where Is Our Constitutional Right To Due Process

For those of us old enough to remember the old Soviet Union (USSR), where the people had few if any rights might see some similarities.

Little by little our constitutional rights have been taken from us and what is taken is NEVER returned.  It all began with the so called Patriot Act.  A removal of many of our rights in the name of national security.  Now this Act has bled over to other areas of our Constitution.

The following story by GRETCHEN MORGENSON and GERALDINE FABRIKANT - published: September 4, 2010. in the New York Times - Florida's High-Speed Answer to a Foreclosure Mess tells a much bigger story then the one reported.

The real story is about the total disregard for Due Process of the Law, a basic Constitutional right we used to all enjoy here in the United States.  These types of actions along with the actions taken under the guise of the Patriot Act bring us ever closer to that once hated, demonic system of the old USSR.  In fact, our civil, constitutional and basic rights once enjoyed here can earn us the new name of the United States of the Socialist Republic (USSR).

As millions of us remain jobless and more millions face losing their homes to "illegal" foreclosure actions there seems to be no support from anyone in our government - Federal, State or Local.  What is happening?

We have seen attorneys all over the country attempting to fight the illegality of what is happening in our court rooms around the country, yet no one seems to want to tackle the problem head on.  I believe this will ultimately be a case heard in the Supreme Court of the United States but I truly doubt they would rule in favor of "the people".

The hiring of retired judges to "clear dockets" is just not right.  If that is their mandate then where is the law? Does the law even matter anymore and if not then anyone facing any court action, be it civil or criminal, has no chance even if innocence is supported by the facts.

Then read the post in an attorney's blog, 4closureFraud - NY Times Picks Up on The Crisis in OUR FL Courts – High-Speed Courts Try to Rush Through Foreclosures.

It is bad enough that our government participated in creating this mess, rewarded the banks for doing so and now take more "illegal" actions to continue the ravage of the average American.

My hat's off to all of the attorney's and the handful of judges around the country who have been willing to stand up for JUSTICE and The American Way but I fear that the handful of them are just not enough.  What we need is a large grass roots effort by "The People" united as we must be to take back our rights and our country.  We need to put the "us" back in the U.S. and fight the demons who will have us be the USSR.

We need to unite as Citizens For The Restoration of Our Rights, send letters with thousands - if not millions - of signatures to our President, Congressmen, US Attorney General, the Attorneys General of all 50 states and to the media to begin this "financial civil war" to restore the real Republic For Which We Stand.

Due process is our RIGHT not privilege.  If this is allowed to happen in our civil courts for foreclosures then that sets precedence for all other actions in all other courts of this land.  In other words, WE LOSE OUR FREEDOMS and the laws are meaningless unless they suit the needs of the establishment.  Wall Street is fast becoming the Kremlin where the super rich are our new rulers.

Nine States Did Not File Initial Claims Data Due To Labor Day, Hundreds Of Thousands Of Estimates In Data "Beat"

The BLS has announced that as a result of the Labor Day weekend, 9 states (among which the biggest one California) did not report initial claims data to the bean counters, so instead the government had to "estimate" what the data would have been: yep, estimate, what the data was in these nine states. From Bloomberg: "For the latest reporting week, nine states didn’t file claims data to the Labor Department in Washington because of the Labor Day holiday earlier this week, a department official told reporters. California and Virginia estimated their figures and the U.S. government estimated the other seven." Official data is now made up on the fly. This US economic data reporting has just entered the twilight zone. Also, when the data is officially made up, it is not that difficult to get data that is "better than expected."

Scientists Find Thick Layer Of Oil On Seafloor

Scientists on a research vessel in the Gulf of Mexico are finding a substantial layer of oily sediment stretching for dozens of miles in all directions. Their discovery suggests that a lot of oil from the Deepwater Horizon didn't simply evaporate or dissipate into the water — it has settled to the seafloor.

Ex- Chief of Quellos Admits Swindling the I.R.S. Out of $240 Million

The executive, Jeffrey I. Greenstein, is a former chief executive and a co-founder of the Quellos Group, whose main business was bought by the global investment firm BlackRock for $1.7 billion in 2007.

Quellos had a roster of star clients, including former President Bill Clinton and Hillary Rodham Clinton; Robert Wood Johnson IV, the owner of the New York Jets; and the Hollywood mogul Haim Sabin, the producer of the Mighty Morphin Power Rangers children’s show.

Mr. Greenstein, 48, pleaded guilty to charges of conspiracy and aiding in the filing of a false tax return in connection with a tax shelter called Point.

In his plea before Judge Ricardo S. Martinez of United States District Court in Seattle, Mr. Greenstein admitted that the shelters, which were sold from 1999 through mid-2006, cheated the Internal Revenue Service out of $240 million in taxes.

  6. Make sure you vote....

Home mortgage modification snags spark lawsuits

Whether the Lake Stevens, Wash., couple keep their home may hinge on the outcome of a legal strategy that aims to join struggling homeowners with similar experiences in the HAMP program in a class-action lawsuit against the nation's largest bank. On Sept. 30 in Nashville, a federal court hearing is scheduled to consider consolidating the Sopers' case with more than a dozen others against Bank of America.

Similar lawsuits, also seeking class-action status, are pending against other major servicers such as JPMorgan Chase and Wells Fargo. Taken together, the cases threaten to amplify a growing public frustration with mortgage servicers' treatment of HAMP borrowers and HAMP's modest results. Permanent modifications, which lower mortgage payments to 31% of a borrower's pretax monthly income for five years, have been given to only about a third of the 1.3 million borrowers in trial plans since the program's launch in April 2009.

Most of the lawsuits allege that the three- or four-month trial payment plans are contracts, and that Bank of America and other servicers broke them by not giving permanent modifications to homeowners who made their trial payments on time and provided the necessary documentation.

  8. Arianna Huffington's new book, Third World America: How Our Politicians are Abandoning the Middle Class and Betraying the American Dream

speaks for the disenfranchised middle class: Americans that have lost wages, lost jobs, lost value in homes, and lost substantial value in investments and retirement funds. The U.S. middle class is being scammed out of existence. Wall Street and large corporate special interests -- including energy companies, large financial institutions, drug companies, and the large military industrial complex -- effectively bought Washington.

The recession was over for bailed-out banks paying billions in bonuses. Taxpayers fund Wall Street with nearly zero-cost loans, and Congress changed accounting rules in April 2009 so that Wall Street firms could hide losses to create the illusion of "big profits," as they try to fill the gaping holes in their balance sheets.

  9. What about our veterans? Look at the $ spent on rent at this hole? What about care for these men?

Maggots found in eye socket of man in nursing home with Palm Beach County ties

A Veterans Administration official confirmed the agency filed a report with the Adult Protective Services unit of the Florida Department of Children and Families.

"Please note that the discussed veteran was not under VA care when this matter occurred at this non-VA nursing home," said VA spokeswoman Cindy Gaylord in an e-mail. "The veteran was brought to our medical center for care and shortly thereafter, the issue was forwarded to Adult Protective Services, Department of Children/Family Service for investigation."

DCF spokesman John Harrell said: "We are very concerned about these disturbing allegations. We are actively and thoroughly investigating to get to the bottom of what happened."
